Coles Instant Win Competition ("promotion")

 

TERMS & CONDITIONS

1. The Promoter is Coles Supermarkets Australia Pty Ltd ABN 45 004 189 708 of 800 Toorak Road, Hawthorn East, VIC 3123, referred to herein as 'Coles’ ("Promoter").

2. The Promotion is administered by TLC Marketing Worldwide Asia Pacific Pty Ltd, ABN 75 622 802 180, Level 3, 100 Harris Street, Sydney, NSW 2009,  (“TLC”).  All correspondence regarding this Promotion should be directed to this address. 

3. Instructions on how to enter and claim form part of these terms and conditions.

4. Participation in this Promotion is deemed acceptance of these terms and conditions. 

5. In these Conditions of Entry, Coles Supermarkets in Australia that are participating in the Promotion are referred to as “Coles store”.

 

CONDITIONS OF ENTRY

A qualified entrant must meet the following conditions of entry (“Qualified Entrant”) 

6. This Promotion is only open to Australian residents aged 18 years and over at the time of entry. Employees (and their immediate families) of the Promoter, TLC and agencies associated with this Promotion who has influence over the allocation of rewards are ineligible to participate in this Promotion.  Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. 

7. As a condition of entering this Promotion, an Entrant consents to, in the event they are a  Major Prize or Hero Prize winner, the Promoter or TLC using the Entrant’s name, in any media in Australia for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the Promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter or TLC. 

 

KEY DATES

8. The Promotion is open for Qualifying Purchases (defined below) made between 12.01am AEST on 29/07/2020 and 11.59pm AEST on 22/09/2020 (“Purchase Period”).

9. The claim period opens 12.01am AEST on 29/07/2020 and closes 11.59pm AEST on 06/10/2020 (“Claim Period”).

10. The Redemption Period opens 12.01 am on 29/07/2020 AEST and all the digital vouchers have 18 months validity from date of issue with specifications set out below (“Redemption Period”) 

Mass-tier rewards  Some digital vouchers require activation – details outlined in Schedule 1. Customer can activate it anytime during the 18 months validity period, once activated, the voucher is valid for 3 calendar days.  
Major prizes TLC will send verification email to winners within 3 business days and issue the prize within 30 days. 
Hero prizes TLC will send verification email to winners within 3 business days and issue the prize within 30 days.

HOW TO ENTER 

11. To be eligible to participate in the Promotion, entrants must, during the Purchase Period:

  • Visit Coles in store or via Coles Online and purchase any 3 participating products (participating products are marked in-store and listed at www.coles.com.au/instantwin)  in one transaction (“Qualifying Purchase”). A unique code will be presented on the bottom of the receipt or on the Coles Online invoice and customers must retain the receipt/invoice for all entries in case of prize verification. Each entry will require a separate unique code.  In the event a receipt or invoice are not supplied, it is the entrant’s responsibility to request one. 

To claim, entrants must, during the Claim Period:

I. Visit www.coles.com.au/instantwin  

II. Input the unique code from the purchase receipt; 

III. Accept the promotional terms and conditions

IV. Entrants will be notified on screen and via email which reward (“Instant Prize”) they have won.  

12. Entrants who perform the above steps (“Qualified Claim”) will receive an email within 3 business days. The email will detail exactly how to redeem the Instant Prize.

13. Multiple claims are permitted, subject to the following: 

  • Only one (1) Unique Code per claim is permitted; 
  • Each claim must be submitted separately and in accordance with entry requirements of these terms and conditions; 
  • Maximum of 5 claims per day per customer;
  • The same Unique Code cannot be used more than once; 

14. All Instant Prizes are subject to the terms and conditions of individual promotional partners, which are outlined in Schedule 1. 

 

OTHER GENERAL TERMS & CONDITIONS

15. For each prize claim that an Entrant submits, the Entrant must keep the receipt that bears the Unique Code submitted at the time of claim or entry. 

16. Incomprehensible, indecipherable and incomplete entries may, at TLC’s discretion, be deemed invalid and not eligible for Reward.

17. The Reward is personal to each Qualified Entrant, and cannot be exchanged, transferred, shared or assigned in any manner.  Rewards cannot be used or redeemed in conjunction with any other Promotion.

18. Redemption of codes is available online only and therefore access to the internet is required to participate in this Promotion.  Any cost associated with accessing the promotional website is the Entrant's sole responsibility and is dependent on the Internet service provider used by the Entrant.

19. Any ancillary costs associated with redeeming the reward are not included.  Any unused balance of the reward will not be awarded as cash.  Redemption of the reward is subject to any terms and conditions of the issuer.

20. The Promoter (including its directors, officers, employees and agents) and TLC reserve the right, at any time, to verify the validity of claims and the Qualified Entrant (including the Entrant’s identity, age and place of residence) and reserve the right, in their discretion, to disqualify any individuals who they have reason to believe has breached any of these terms and conditions, tampered with the claim process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion.  Errors and omissions may be accepted at the Promoter’s and TLC’s discretion. The Promoter's and TLC's legal rights to recover damages or other compensation in such circumstances are reserved.

21. Failure by the Promoter or TLC to enforce any of their rights at any stage does not constitute a waiver of those rights.  The Promoter’s and TLC’s legal rights to recover damages or other compensation arising as a result of such conduct are reserved.

22. The Promoter (including its directors, officers, employees and agents), TLC, its respective agents, promotional partners and distributors are not liable for lost, stolen or damaged Rewards, and to the extent permitted by law do not make any contractual promise or representation regarding the quality and/or availability of the services offered and cannot be held liable for any resulting personal loss or damage.

23. The Reward is subject to availability. If the Reward is unavailable, for whatever reason, TLC reserves the right to withdraw or substitute the Reward for a reward of equal value and/or specification, subject to any written directions from a regulatory authority.

24. All promotions and offers by are subjected to a set of terms and conditions, which the Promotor or TLC reserve the right to vary without prior notice. The right to amend terms and conditions includes changing the definition of a qualified purchase, terminating the offer before stated validity date, changing the details of the promotion or offer or any other changes. 

25. The Promotional Website may contain links to other websites (“Linked Sites”), including Promotional Partner Websites. The Promoter is not responsible for the content of any Linked Sites, whether or not the Promoter is affiliated with the Linked Sites. The Promoter does not in any way endorse any Linked Sites and is not responsible for the quality or delivery of any products or services offered, accessed or advertised by such Linked Sites. To the extent that these Linked Sites collect personal information or postings from Entrants, the Promoter shall bear no responsibility or liability for the manner in which such information or postings are used or exploited. The Linked Sites are for Entrants’ convenience only and Entrants agree to access them at their own risk. 

26. In the event that for any reason whatsoever a Qualified Entrant does not take or claim a Reward (or an element of a Reward) at or by the time stipulated by the Promoter or TLC, then that Reward (or that element of the Reward) will be forfeited and cash will not be awarded in lieu of that Reward (or element of the Reward).

27. Except for any liability that cannot be excluded by law, the Promoter (including its directors, officers, employees and agents), TLC and the Promotional Partners (including their respective officers, employees and agents) are not responsible for and exclude all liability (including for negligence) for: any personal injury, death or harm suffered by the Entrant or other person who redeems the Reward (and Qualified Entrant releases Promoter and TLC from any such liability – including any other person who redeems the Reward); or any loss or damage (including loss of opportunity), whatsoever, whether direct, indirect, special or consequential, arising in any way out of:

i. any technical difficulties or equipment malfunction (whether or not under the Promoter’s or TLC’s or Promotional Partners’ control);

ii. any theft, unauthorised access or third-party interference;

iii. any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter or TLC or Promotional Partners) due to any reason beyond the reasonable control of the Promoter or TLC or Promotional Partners;

iv. any variation in Reward value to that stated in these terms and conditions;

v. any tax liability incurred by a Qualified Entrant or claimant; or

vi. the use and/or taking of a Reward.

28. Should a Qualified Entrant’s contact details change during the Promotion, it is the Entrants responsibility to notify TLC on 1800 841 803 between the hours of 9:30am (AEST) and 5:00pm (AEST) or email contact@colesinstantwin.com.au during the Promotional Period (inclusive) Monday to Friday except for Public Holidays in NSW. A request to access or modify any information provided in claim/entry should be directed to TLC.

29. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason, including by outside act, agent or event that is beyond the reasonable control of the Promoter or TLC, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter or TLC reserves the right, in their sole discretion, to the fullest extent permitted by law:

i. to disqualify any Qualified Entrant; or

ii. to modify, suspend, terminate or cancel the Promotion, as appropriate.

30. The terms of the Reward are as stated in these terms and conditions and no other representations (written or oral) shall apply. Nothing in these terms affects any statutory rights a Qualified Entrant may have including under the Australian Consumer Law.

31. Personal information (PI) is being collected by TLC and the Promoter in order to conduct this Promotion. For this purpose, TLC and the Promoter may disclose PI to third parties, including but not limited to their employees, agents, contractors, service providers, suppliers and, as required to under any applicable law, to regulatory authorities. Participation is conditional on a claimant providing TLC and the Promoter this PI. TLC will use and handle personal information as set out in its Privacy Policy, which can be viewed at https://www.tlcmarketing.com/legals. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.coles.com.au/privacy In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter, and the Coles Group of companies, may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Each Privacy Policy also contains information about how Qualified Entrant may opt out, access, update or correct their PI, how Qualified Entrant may complain about the treatment of their PI, and how those complaints will be dealt with, subject to the consent that a claimant provides above at clause 31 above. The Promoter and TLC may disclose personal information to entities outside of Australia (for a list of countries, see the Promoter’s or TLC’s Privacy Policies).

32. Schedule 1 - ADDITIONAL TERMS AND CONDITIONS FOR INSTANT PRIZE

INSTANT PRIZES GENERAL

1. The value of each Instant Prize, the total number of possible Instant Prizes to be awarded for the Promotion and the total maximum value of the Instant Prizes are in accordance with the table above. 

2. Each prize is valued in Australian Dollars inclusive of GST (if any) based on the recommended retail value at the time of printing. The Promoter and TLC takes no responsibility for any variations in the value of a prize.

3. The maximum number of instant prizes giving away for this promotion is 15,120,532 and the maximum total value of all prizes in the Promotion is up to AUD$284,920,891. The final number of prizes distributed by the Promotor or TLC will be the number of prizes claimed by the entrants. 

4. Prize Redeem Procedure

Mass-tier rewards

  • For each Qualified Claim, customer will receive an email within 3 business days of claimed. The email will detail exactly how to redeem individual reward along with a Reward code (“Reward Code”). All claims need to be submitted by 11.59pm AEST on the 06/10/2020.
  • The Reward Code is valid for 18 months from date of issue or by 06/04/2022, whichever is earlier. 
  • Some of the Reward Codes require activation, including Free Yoga Class, $10/ $20 Dymocks Books Voucher, $20/ $50 Endota Spa Gift Card, $10/ $20 Endota Spa Gift Card towards a Manicure Treatment, $25/ $50 Glamping Hub Voucher, $10/ $15 Menulog Voucher. To activate, customer simply reply to the email when ready to redeem and request to activate the Reward Code. A Voucher will then be sent to the customer within 2 business days and is valid for 3 calendar days.

Major prizes & Hero Prizes

  • For each Qualified Claim, customer will receive a verification email within 3 business days of claimed on the prize they have won. The Entrant might be requested to provide:
    • A scanned copy of the physical receipt which shows the unique code
    • Information that is personal to the Entrant, including their full name, date of birth, address and contact telephone number. 
    • After the Entrant has satisfactorily responded to the Verification Email, and TLC has conducted preliminary verification checks (as determined by the Promoter and/ or TLC in its or their absolute discretion). The prize will be arranged to be sent within 30 days.
    • Prizes is valid for 18 months from date of issue (if applicable).
    • Any winner/s will be informed in writing by email within 3 business days. Major and Hero prize winners will have their name and postcode published online at www.coles.com.au on 13/10/2020 for a period of 28 days.

5. Second chance draw

If for any reason, there are Major and Hero prizes that have not been awarded by the closing date of the Claim Period, the promoter will carry out a second chance draw at the date, time and place stated below to randomly distribute the prize/s in descending order of value amongst valid entrants. 

The draw:

I. The second chance draw will take place on 01/03/2021 at 11:00 AM (AEDT) at TLC Marketing Worldwide Asia Pacific Pty Ltd, ABN 75 622 802 180, Level 3, 100 Harris St, Pyrmont NSW 2009 Australia by computerised draw system or selection. TLC warrants that the computerised draw system used to draw the prizes has been appraised by a suitably qualified person into the operation and integrity of the computerised draw system. The winning entrant does not need to be present at the draw to claim a prize. 

II. Reserve winners will be drawn and record them (in order) in case an ineligible entrant is drawn or if any entrant drawn is unable to accept or declines to participate in a prize within fourteen (14) days of being successfully notified that they are a winner (if applicable),  then the prize will be awarded to the reserve winner.  

6. If a prize (or part of a prize) becomes unavailable, for any reason beyond the Promotional Partner or Promoter’s reasonable control (as applicable), then a comparable prize (or part of a prize) of equal or greater value will be awarded in lieu at the Promotional Partner or Promoter’s discretion, subject to any written directions made under applicable State or Territory legislation.

7. Prizes are not transferable or exchangeable and cannot be taken as cash (unless otherwise indicated). Prizes must be taken as offered and cannot be varied. Prizes cannot be used or redeemed in conjunction with any other offer. The Promoter accepts no responsibility for any tax implications that may arise from any prize winnings. Independent financial advice should be sought. 

8. It is the responsibility of the claimants to use their rewards by the specified expiry date. The prizes are issued with the understanding that it will not be extended or replaced. 

9. Timeframes for delivery indicated in these terms and conditions may be affected by circumstances outside of the control of TLC, including, but not limited to strikes, fires, floods, earthquakes, other natural disasters, acts of terrorism, and blackouts.  TLC and the Promoter will not be liable for delays caused by circumstances outside of its control. 

10. Prizes will be delivered (if applicable for TP Toys Hilltop Wooden Tower Playhouse with Slide and TP Toys Wooden Treetop Tower Playhouse Set) to Australian addresses only. 

11. All Promotion advertisements depicting prizes, prize descriptions and/or trademark references are illustrative rather than definitive and do not imply any association with the Promoter. 

12. If a winner fails to redeem an Instant Prize in the manner required, as stated in these terms and in the reasonable opinion of the Promoter or TLC, the Instant Prize will be forfeited with no compensation payable. 

 

CONDITIONS ATTACHED TO THE REWARDS

MASS-TIER PRIZES

$10/ $20/ $50 Mountain Bike Experience Voucher

1. The Promotional Partner for the Mountain Bike Experience Voucher is TLC Marketing Worldwide Asia Pacific Pty Ltd (ABN 75 622 802 180) (“TLC”).

2. A Mountain Bike Experience Voucher entitles the winner to one (1) $10 or $20 or $50 off the Mountain Bike Experience to a participating venue, subject to the terms stated here. 

3. Within 3 business days of submitting the claim online, a Reward Code along with a table of participating venues will be sent to the claimant. The table will detail out the location and the types of Mountain Bike Experience available for each participating venue.  

4. When ready to redeem, claimant simply email TLC the preferred venue and a Venue eVoucher will be sent in 2 business days. If alternative or additional instructions apply, these will be noted on the email with the Venue eVoucher. The last date to redeem any experience is 18 months from date of Reward Code issue, or by 06/04/2022, whichever is sooner.

5. Claimant is required to present the Mountain Bike Experience eVoucher on the day of usage. Each Mountain Bike Experience Voucher is non-cumulative, cannot be used in conjunction with any other offer and it cannot be redeemed for cash and is not for resale. No duplications of eVouchers will be accepted. 

6. Only one voucher can be used per transaction/ booking. 

7. Only one (1) Mountain Bike Experience Voucher may be used per group per venue. Participating venues may not allow multiple members of a group to redeem their Vouchers at the same time. 

8. Additional restrictions on validity, age and height restrictions may apply – please check with the chosen participating venue. The claimants acknowledge that a prize may involve a dangerous activity, which may result in injury or death, and participate at their own risk.

9. The participating venue in their absolute discretion, reserve the right to refuse to allow the claimants to take part in any or all aspects of a prize if they reasonably believe the claimants pose a safety risk or for any other reason.

10. Use of Mountain Bike Voucher are subject to availability at participating venues and their use may be limited during public and school holidays and other peak periods. 

11. Any disputes between claimants pertaining to the use of Mountain Bike Experience Voucher are strictly between the claimant and the Participating venue.

12. The Promoter, TLC or the Participating Outlet shall not be liable for any claim, loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, except for any liability which cannot be excluded by law and the user of the Mountain Bike Experience Voucher indemnifies the Promoter and the Participating Outlet in relation to any claim, loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury which is suffered or sustained.

13. TLC, its respective agents and distributors do not make any contractual promise or representation regarding the quality and/or availability of the products offered by the participation venue and cannot be held liable for any resulting personal loss or damage.

 

$10/ $20/ $50 Surfing Lesson Voucher 

1. The Promotional Partner for the Surfing Lesson Voucher is TLC Marketing Worldwide Asia Pacific Pty Ltd (ABN 75 622 802 180) (“TLC”).

2. A Surfing Lesson Voucher entitles the winner to one (1) $10 or $20 or $50 off the Surfing Lesson to a participating venue, subject to the terms stated here. 

3. Within 3 business days of submitting the claim online, a Reward Code along with a table of participating venues will be sent to the claimant. The table will detail out the location and the types of Surfing Lesson available for each participating venue.  

4. When ready to redeem, claimant simply email TLC the preferred venue and a Venue eVoucher will be sent in 2 business days. If alternative or additional instructions apply, these will be noted on the email with the Venue eVoucher. The last date to redeem any experience is 18 months from date of Reward Code issue, or by 06/04/2022, whichever is sooner.

5. Claimant is required to present the Surfing Lesson eVoucher on the day of usage. Each Surfing Lesson Voucher is non-cumulative, cannot be used in conjunction with any other offer and it cannot be redeemed for cash and is not for resale. No duplications of eVouchers will be accepted.

13. TLC, its respective agents and distributors do not make any contractual promise or representation regarding the quality and/or availability of the products offered by the participation venue and cannot be held liable for any resulting personal loss or damage.

 

One Free Yoga Class

1. The Promotional Partner for the Free Yoga Class is YogaHive Collective Pty Ltd (ABN 63 610 473) (“YogaHive”).

2. The Free Yoga Class entitles the customer to one (1) free yoga class at participating venues. 

3. Once the Reward Code is activated, claimant will receive the YogaHive Voucher and is required to redeem by booking in a class within 3 calendar days.

4. To redeem the Free Yoga Class:  

  • customers create an account via www.yogahive.com.au, chooses to purchase a 1(One) class of YogaHive Pass on their dashboard by uploading the voucher code and clicking Apply. A class can then be booked for free.

5. Classes may be conducted either in the Studio or Online depending on venue chosen.

6. Customers can use a maximum of 1(One) YogaHive Pass per studio. 

7. YogaHive passes are introductory for first time student only.

8. YogaHive passes are easily transferable to friends and family by logging in to www.YogaHive.com.au 

9. All venues require advance bookings and may be limited for use at certain times, please check the venues terms and conditions before you visit your chosen venue.

10. Free Yoga Class cannot be used in conjunction with any other offer or Voucher. This reward has no cash value and is not for resale.

11. Free Yoga Class codes must be redeemed on the partner website www.yogahive.com.au which can be found following the instructions in the email containing the yoga code.  

12. Entry conditions, session times and classes may vary from venue to venue. Customers should check with their chosen venue regarding minimum age restrictions, what to bring etc. 

13. All Free Yoga Class are issued for a group activity unless otherwise stated.

14. The Promoter, TLC or the Participating Outlets shall not be liable for any claim, loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, except for any liability which cannot be excluded by law and the user of the Free Yoga Class indemnifies the Promoter and the Participating Outlet in relation to any claim, loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury which is suffered or sustained.

15. Any disputes between claimants pertaining to the use of Free Yoga Class are strictly between the claimant and the promotional partner. 

16. TLC, its respective agents and distributors do not make any contractual promise or representation regarding the quality and/or availability of the services offered by the venues and cannot be held liable for any resulting personal loss or damage

 

$10/ $20/ $50 Canyoning & Rock Climbing Voucher 

1. The Promotional Partner for the Canyoning & Rock Climbing Voucher is TLC Marketing Worldwide Asia Pacific Pty Ltd (ABN 75 622 802 180) (“TLC”).

2. A Canyoning & Rock Climbing Voucher entitles the winner to one (1) $10 or $20 or $50 off the Canyoning & Rock Climbing experience to a participating venue, subject to the terms stated here. 

3. Within 3 business days of submitting the claim online, a Reward Code along with a table of participating venues will be sent to the claimant. The table will detail out the location and the types of Canyoning & Rock Climbing experience available for each participating venue.  

4. When ready to redeem, claimant simply email TLC the preferred venue and a Venue eVoucher will be sent in 2 business days. If alternative or additional instructions apply, these will be noted on the email with the Venue eVoucher. The last date to redeem any experience is 18 months from date of Reward Code issue, or by 06/04/2022, whichever is sooner.

5. Claimant is required to present the Canyoning & Rock Climbing eVoucher on the day of usage. Each Canyoning & Rock Climbing Voucher is non-cumulative, cannot be used in conjunction with any other offer and it cannot be redeemed for cash and is not for resale. No duplications of eVouchers will be accepted.

Should the winner does not require domestic flight to get to the location of the Skyhouse, the Flight tickets for two (2) person will be issued in the form of 1 x $500 Qantas Flight voucher or 1 x $500 Flight Centre Voucher, subject to the winner’s preference. 

4. The prize includes GST and taxes included in the price of the ticket. Unless otherwise stated, any purchases made over and above the prize amount will be at the winner’s expense. All additional costs not expressly stated, but which may be incurred in acceptance and use of the prize, are the responsibility of the winner and their companion. Such additional costs include, but are not limited to, meals, beverages, room service, telephone calls, laundry services, spending money, transport to and from airport departure point, other transfers, taxes including arrival and departure taxes (if applicable) but excluding airfare related taxes and charges included in the prize, insurance, travel insurance, passports and visas (if applicable). The winner (or their parent or legal guardian, if the winner is aged under 18 years) may be required to present a credit card at time of accommodation check-in.

5. Prize travel and accommodation is subject to availability at the time of booking. The winners and their companions must travel together and depart from and return to the same departure point on all prize travel and will not accrue airline points on any element of the prize. An upgrade cannot be purchased on airfares with cash or airline rewards Points. All components of the prize must be taken together and when offered or are forfeited. No extension or variation of the travel and/or accommodation dates nominated by the Promoter is permitted.

6. Prize travel and accommodation must be booked and travel must be completed by 06/04/2022. Claimant will bear the cost should there be any changes to travel arrangements once tickets have been issued or accommodation bookings once the reservation is confirmed.

7. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. The prize must be used in one transaction. Prizes are not exchangeable or redeemable for cash or other goods or services.  A prize cannot be transferred to any other person, unless agreed to by the Promoter.  It is a condition of accepting a prize that the winner accept the conditions of use of that prize.

8. The Weekend Retreat prize cannot be used in conjunction with any other offer and it cannot be redeemed for cash.
