Coles Plus Saver Terms and Conditions

Overview

These Terms and Conditions apply to Coles Plus Saver subscriptions purchased from 15 March 2024. Coles Plus Saver will undergo a product customer trial, and during this trial the subscription will only be available for customers to sign up if they are based in Victoria or Tasmania. Coles Plus Saver is not available for Coles for Business customers. Customers can choose to sign up for both Coles Plus Saver and Coles Plus subscriptions, and the associated member benefits will be combined (see clause 18). Coles Plus Saver members are not required to sign-up to Coles Plus, and vice versa.

Subject to these Terms and Conditions, Coles Plus Saver is a subscription service that provides:

(a) 10% off one Coles Supermarkets transaction every calendar month on eligible items (instore, app or online) with a maximum discount value of $50 per calendar month;

(b)   Double Flybuys points at Coles Supermarkets, First Choice Liquor Market and Liquorland on eligible items (instore, app or online); and

(c)   exclusive subscriber-only free products, offers and promotions communicated to Coles Plus Saver members from time to time,

(collectively the “Subscription Benefits”).

The Subscription Benefits are valid for eligible items from Coles Supermarkets, First Choice Liquor Market and Liquorland (as applicable to the relevant Subscription Benefit) during the relevant Subscription Period, after savings and discounts have been applied. Purchases made online at Coles Supermarkets, First Choice Liquor Market and Liquorland may have minimum spend thresholds.

Coles Plus Saver Subscription Benefits are not valid for purchases of all gift cards, iTunes cards, Coles Best Buys Online Exclusive products, charity items/donations, tobacco and tobacco related products, mobile recharge, online delivery fees, Coles Plus Saver subscription fees, Coles Plus subscription fees, or purchases from Coles Express, DoorDash, UberEats and Vintage Cellars.

Subscriptions are to be paid monthly and cost $7.00 per month.

By purchasing the Coles Plus Saver subscription, you agree to be bound by these Terms and Conditions which are to be read in conjunction with Coles Online Customer Agreement. In the event the Coles Plus Saver subscription service trial is suspended, members will receive at least thirty (30) days’ notice.


Capitalised terms can be found in the 'Definitions' section, which appears at the end of these Terms and Conditions.
 

Conditions of Use

1. Coles Plus Saver is an opt-in paid subscription service and requires you to sign up online or via the Coles app to participate in the Coles Plus Saver offer. 

2. The Coles Plus Saver Subscription Benefits are only valid for eligible items from Coles Supermarkets, First Choice Liquor Market and Liquorland (as applicable to the relevant Subscription Benefit) during the relevant Subscription Period, after savings and discounts have been applied. Purchases made online at Coles Supermarkets, First Choice Liquor Market and Liquorland may have minimum spend thresholds. Service fees, smoking and tobacco products are excluded from the minimum spend threshold. You have the right to cancel your subscription at any time as per clauses 30 to 34.

3. Your Coles Plus Saver membership can be linked to your Flybuys account. Only one Coles Plus Saver subscription per Flybuys account will be accepted to receive double Flybuys points and 10% discount member benefits. If a Flybuys account is linked, any member on that Flybuys account can access the benefits, however the 10% discount benefit can only be used once per calendar month per Flybuys account. The Coles Plus Saver subscription is for the sole use of the Coles Plus Saver account holder, or Flybuys account (inclusive of all card holders), and cannot be transferred to, shared, or used for Orders for another customer. No person other than the Coles Plus Saver account holder, or Flybuys account holder/s, may use the associated Coles barcode or Flybuys account to access Coles Plus Saver member benefits.

4. The Coles Plus Saver subscription is valid to use any day of the week throughout the relevant Subscription Period and costs $7.00 per month.

5. Coles online delivery is subject to the Coles Online Customer Agreement and the Coles Liquor Terms of Use for Website.

10% off one Coles Supermarkets transaction per calendar month (instore, app or online)

7. Coles Plus Saver members will receive 10% off one Coles Supermarkets transaction per calendar month (instore, app or online) with a maximum discount value of $50 per month. The 10% off discount is not available on transactions at First Choice Liquor Market or Liquorland (instore, app and online).

8. 10% discount can be applied to one Coles Supermarkets transaction per calendar month (instore, app or online) during the relevant Subscription Period, after savings and discounts have been applied. Purchases made online at Coles may have a minimum spend threshold.

9. If a Coles Plus Saver member chooses to apply the 10% discount for an instore Coles Supermarkets transaction, they are required to scan their Coles barcode or linked Flybuys card at the time of purchase. Members can follow the prompts to apply the discount against their payment total. The Coles barcode is available to access via the Coles App. If a member has a pending online or app Coles Supermarkets order with a Coles Plus Saver 10% discount applied, a member may choose to transfer the 10% discount to an applicable instore shop for the same calendar month if the online or app order is not already processed.

10. If a Coles Plus Saver member chooses to apply the 10% discount for an online or app Coles Supermarkets Order, members can follow the prompts at checkout to apply the discount against their payment total. The discount will be deducted from the payment total when final payment is processed and will appear on the invoice within the "Loyalty discounts" section. The discount will not display in communications prior to the final payment being processed (for example it will not display at checkout or within the Order confirmation email). The 10% discount will be applied based on the final Order value. Where an item is out-of-stock and the Coles Plus Saver member has elected not to receive substitutions, the 10% discount will be applied based on the final Order value, after any necessary deductions are made for the out-of-stock item.

11. If a Coles Plus Saver member does not choose to apply the 10% discount to a transaction within a calendar month, the Coles Plus Saver member will not receive the 10% for that calendar month. Any unused 10% discount will expire at the end of each calendar month.

12. 10% discount is only available for one Coles Supermarkets transaction per calendar month. If a member places an online Order and the delivery or collection falls within the following calendar month, the discount will be allocated to the month the Order is delivered or collected. For example, if you placed an online Order on the 31st of March and applied the 10% discount, and the Order was delivered or collected on the 1st of April, the 10% discount will count towards the monthly allocation for April.

13. If the 10% discounted online Order is refunded or cancelled by a Coles Plus Saver member after the Order cut-off time, the discount will be void for the allocated calendar month.

14. 10% discount is not valid for purchases of all gift cards, iTunes cards, Coles Best Buys Online Exclusive products, charity items/donations, tobacco and tobacco related products, mobile recharge, online delivery fees, Coles Plus Saver subscription fees, Coles Plus subscription fees, or purchases from Coles Express, DoorDash, UberEats and Vintage Cellars.
 

Double Flybuys points on Coles, First Choice Liquor Market and Liquorland purchases (instore, app and online)

15. Coles Plus Saver subscribers who link their Flybuys membership to their Coles account will collect 2 points per $1 spent on eligible items at Coles, First Choice Liquor Market and Liquorland when they (1) present their Flybuys or linked Coles barcode instore at Coles, (2) shop with their linked online Coles account (3) present their Flybuys instore at First Choice Liquor or Liquorland, or (4) enter their Flybuys membership account details when placing an online order for liquor purchases at First Choice Liquor and Liquorland. Only one Coles Plus Saver subscription per Flybuys household account will be accepted to receive double Flybuys points. Purchases from First Choice Liquor Market and Liquorland can be made instore and online only, and not via the Coles app. Points are unable to be awarded retrospectively, so please ensure you provide your Flybuys number before completing your purchase. 

16. Double Flybuys points means 1 standard Flybuys point and 1 bonus point per $1 spent on eligible items. Double Flybuys points will not apply to individual bonus points offers.

17. Once Coles Plus Saver subscription is linked to a Flybuys account, either Coles barcode or Flybuys card can be scanned to apply membership benefits from both programs. Flybuys members with a Coles Plus Saver subscription are required to scan their Coles barcode or Flybuys barcode at the time of purchase instore at Coles Supermarkets or scan their Flybuys barcode at the time of purchase instore at First Choice Liquor Market and Liquorland to collect 2 points per $1 spent on eligible items. The Coles barcode is available to access via the Coles App.

18. Flybuys members that hold valid Coles Plus and Coles Plus Saver subscriptions, can combine their bonus points benefits when they present their Flybuys or linked Coles barcode at the time of purchase. The individual account offer of Double Flybuys points is equal to 1 standard and 1 bonus point per $1 spent. Flybuys members can only receive the 1 standard point per $1 spent at Coles once. If Coles Plus and Coles Plus Saver benefits are combined eligible members will receive:

19. If an online Order is refunded or cancelled, you will not be eligible to collect Flybuys points and any issued points may be deducted from your Flybuys account. 

20. Points awarded after savings, discounts and vouchers. Excludes purchases of all gift cards, iTunes cards, Coles Best Buys Online Exclusive products, charity items/donations, tobacco and tobacco related products, mobile recharge, online delivery fees, Coles Plus Saver subscription fees, Coles Plus subscription fees, or purchases from Coles Express, Vintage Cellars or purchases made using any third-party ordering platforms including DoorDash and UberEats. Standard Flybuys terms and conditions apply.

21. The number of Flybuys points awarded is calculated by reference to the Australian dollar amount of the transaction. Your Flybuys card number must be entered or scanned at time of purchase or linked to your Coles Online account.

22. Liquor delivery may not be available in certain areas (please see our List of Areas  we don’t currently service for more information) and may be subject to further purchase conditions (please see Orders with Liquor and Tobacco for more information).

23. Orders taken and fulfilled by Liquorland Australia Pty Ltd ABN 82 007 512 414 (Licence Numbers 6020029967, 14005558, 32059704, 80063, LIQP770010162, 50102218, LIQP700382090 [Type of licence – Tavern licence. Name of licensee – Queensland Venue Co. Pty Ltd. Address – 1120-1124 Albany Highway, Bentley WA 6102. Telephone number – (08) 6254 6200]) in accordance with liquor licensing laws. This offer excludes the Port Hedland and South Hedland, WA and NT areas. All orders must be placed and received by persons aged 18 years or older, proof of age must be supplied on request. SA: WARNING: Liquor Licensing ACT 1997: liquor must not be sold or supplied to persons under 18. Flybuys and its liquor partners support ID25, DrinkWise (get the facts drinkwise.org.au) and the responsible enjoyment of alcohol.
 

Communications and other benefits

24. By purchasing the Coles Plus Saver subscription, you will not automatically be opted in to receiving Coles promotional email communications, however a member will need to be opted into promotional emails to periodically receive communications regarding subscriber-only benefits (for example, free products, offers and promotions). There are also some messages that we must be able to send you, including messages relating to your Coles Plus Saver subscription and changes to your account. To update your promotional communication preferences, log into your online Coles account and select “Marketing preferences” from the Account menu.

25. From time to time, you may be selected to participate in trials to receive free product samples or gifts from Coles Plus Saver or our partners. If applicable, free product samples and gifts will be delivered to your most recent home delivery address used when placing an Order via coles.com.au. If you do not want to receive free product samples or gifts, you can opt out by contacting the Coles Plus Priority Customer Care team. 26. From time to time, we may issue customers with Coles Plus Saver promotional codes to adjust the Coles Plus Saver subscription charge. These promotional codes are specific to the customers they are issued to and cannot be transferred or sold. The subscription promotional codes are subject to the specific offer terms disclosed to customers at the time of issue. We reserve the right to cancel any or all subscription promotional codes at any time if we suspect error, fraud or any other abuse of the codes is occurring.

27. As part of your Coles Plus Saver subscription, you will receive access to a Priority Customer Care phone line and email address to resolve any issues or concerns. The Priority Customer Care line may be used for other Coles customers in exceptional circumstances.
 

Exclusions

28. Coles Plus Saver is not available for Coles for Business customers.

29. Coles Plus Saver Subscription Benefits are not valid for purchases of all gift cards, iTunes cards, Coles Best Buys Online Exclusive products, charity items/donations, tobacco and tobacco related products, mobile recharge, online delivery fees, Coles Plus Saver subscription fees, Coles Plus subscription fees, or purchases from Coles Express, Vintage Cellars,  purchases made using any third-party ordering platforms including DoorDash and UberEats purchase.
 

Auto-renewal, Cancellations and Refunds

30. The Coles Plus Saver subscription is an ongoing subscription. Your Coles Plus Saver subscription as well as your obligation to pay the monthly Subscription Payment will perpetually auto-renew at the end of the Subscription Period unless you give us notice that you wish to cancel.

31. You may cancel the auto-renewal of your Coles Plus Saver subscription at any time by notifying us by visiting your account preferences at coles.com.au and selecting ‘Cancel Subscription’ via the 'Coles Plus Saver subscription' link. You may also cancel your Coles Plus Saver subscription by contacting the Coles Plus Priority Customer Care team. 32. The cancellation of your Coles Plus Saver subscription will take effect from the end of the relevant Subscription Period. You will continue to have the benefit of the Coles Plus Saver subscription for the remainder of the relevant Subscription Period that has been prepaid. You will not be refunded for the remainder of the Subscription Period in which you cancel the auto-renewal of your Coles Plus Saver subscription.

33. You have the right to change your mind and cancel your Coles Plus Saver subscription within 14 days of your Billing Date provided you have not used your Coles Plus Saver subscription in that time. If you wish to get a refund of the Subscription Payment for the Subscription Period that has been prepaid, you must contact our Coles Plus Priority Customer Care team via email on colespluspriority@online.coles.com.au, via text on 0429 989 656 or via phone on 1800 508 308 and we will issue you with a refund of the Subscription Payment for the Subscription Period that has been prepaid. Once your account is cancelled you will not be able to continue to use your Coles Plus Saver subscription.

34. If there are any extenuating circumstances relating to your Coles Plus Saver subscription or your ability to make the Subscription Payment, please contact our Coles Plus Priority Customer Care team via email on colespluspriority@online.coles.com.au, via text on 0429 989 656 or via phone on 1800 508 308.
 

Charging your Nominated Card

35. You must pay the Subscription Payment on each Billing Date during your relevant Subscription Period. If your Billing Date falls on a day which does not exist within a given calendar month, you will be billed on the last day of that month. For example, if you signed up on the 31st of March, then you will be next billed on the 30th of April for that Subscription Period.

36. Any amounts charged to your Nominated Card that exceed the funds or credit limit available on the Nominated Card may be rejected and may result in you being charged fees or interest by the issuer of the Nominated Card.

37. To the extent permitted by law, we are not liable for any loss arising from and any costs incurred in connection with:

(a) us being unable to charge the Subscription Payment to your Nominated Card;

(b) any unsuccessful payment by you of the Subscription Payment using your Nominated Card (including a chargeback or a failure by you to update your details);

(c) you being required to pay the Subscription Payment to us in any other way; or

(d) a variation or termination of these terms and conditions,

except to the extent that this is due to our negligence, fraud or wrongful act or omission.

38. Nothing in these Terms and Conditions limits your rights under the Australian Consumer Law.

39. You authorise us to charge the Subscription Payment to your Nominated Card on each Billing Date. The Subscription Payment and the Billing Date will be disclosed to you at the time that you purchase the Coles Plus Saver subscription.

40. It is your responsibility to ensure that you are able to pay the Subscription Payment on the Billing Date using your Nominated Card and that your Nominated Card details and contact details are up-to-date during the Subscription Period.

41. You warrant that you are over 18 years of age and have the capacity and authority to authorise us to charge the Nominated Card.

42. If you believe there has been an error in charging your Nominated Card or you wish to notify us about anything relating to these Terms and Conditions, including disputes, please contact our Coles Plus Priority Customer Care team via email on colespluspriority@online.coles.com.au, via text on 0429 989 656 or via phone on 1800 508 308.

43. You must pay for the Coles Plus Saver subscription on a monthly basis.
 

Payment Failure

44. If you fail to pay the Subscription Payment by the Billing Date for any reason (including in relation to a chargeback or failure by you to update your payment details), we will give you 48 hours to rectify your payment details for a subsequent attempt of the Subscription Payment. If not rectified and the Subscription Payment is not successfully processed post this time, we will cancel your Coles Plus Saver subscription.


Cancelled Account

45. If your Coles Plus Saver subscription is cancelled, you will not be able to continue to use it and will need to purchase another Coles Plus Saver subscription.

 

Fair Use

46. You may not use the Coles Plus Saver subscription in a manner which is unreasonable or unacceptable and we reserve the right to monitor usage of your Coles Plus Saver subscription for this purpose.

47. For the purposes of clause 44, unreasonable or unacceptable means:

(a)     Using your Coles Plus Saver subscription in circumstances where you have provided us with false user information (including creating multiple false accounts);

(b)     by contravening any applicable laws when you use the Coles Plus Saver subscription service;

(c)      using your Coles Plus Saver subscription in any manner which improperly interferes with another person’s use of the Coles Plus Saver subscription service or for illegal, unlawful or fraudulent purposes; or

(d)     using your Coles Plus Saver subscription in any manner which Coles determines (acting reasonably) is unreasonable or unacceptable having regard to its legitimate business interests. For the purposes of clause 44, unreasonable or unacceptable means: 

48. Where we reasonably determine that you are using your Coles Plus Saver subscription in an unreasonable or unacceptable manner, we may ask you to stop doing so. You must immediately comply with any such request. If you do not, then we may take any steps reasonably necessary to ensure compliance with these Terms and Conditions, which may include cancelling your Coles Plus Saver subscription immediately and without notice to you.

49. Where we reasonably determine that you are using your Coles Plus Saver subscription in an unreasonable or unacceptable manner, we may also reverse the Coles Plus Saver Subscription Benefits which have been allocated to a member if there are any grounds which we consider, in our reasonable discretion, justify a reversal. For example, where you have returned the discounted goods or you have been refunded the discounted goods, the subscription benefits were allocated to you by mistake, or if you collected them by misusing the Coles Plus Saver subscription, or through fraudulent means.
 

Privacy

50. We ensure that your personal information is protected and maintained in accordance with the Privacy Act 1988 (Cth).

51. Our Privacy Policy explains how we collect, use and disclose personal information about you, including how to opt out from direct marketing, how to request access to and correction of your personal information or how to complain about a privacy breach and how this is handled by us. A copy of this policy can be found at www.coles.com.au/privacy. Please call Coles Customer Care on 1800 061 562 for any privacy related queries.

52. Flybuys uses and manages your personal information in accordance with its privacy policy. For any Flybuys related Privacy queries please contact the Flybuys Privacy Officer via email at privacy@flybuys.com.au, via phone on 13 11 16 (Monday to Friday, 9am-7pm AEST, excluding national public holidays) or via post at PO Box 12125, A’Beckett Street, Melbourne, VIC 8006.


General

53. We may vary these terms and conditions at any time and we will notify you of any material changes, including cancelling the Coles Plus Saver subscription service, by giving you at least thirty (30) days’ notice. You have the right to cancel your Coles Plus Saver subscription at any time in accordance with clauses 30 to 34.

 

Definitions

Billing Date means the day you purchase the Coles Plus Saver subscription and the date that is every month after that date during the Subscription Period, as notified at the time you purchase the Coles Plus Saver subscription.

Coles Express means Viva Energy Retail Pty Ltd (ABN 96 662 372 027), trading as Coles Express.

Coles Group means Coles Group Limited (ABN 11 004 089 936) and each of its related bodies corporate from time to time.

Coles Supermarkets means Coles Supermarkets Australia Pty Ltd (ABN 45 004 189 708).

First Choice Liquor Market means Liquorland Australia Pty Ltd (ABN 82 007 512 414 - First Choice Liquor Market), and its affiliated website www.firstchoiceliquor.com.au.

Flybuys means Loyalty Pacific Pty Ltd (ABN 82 057 931 334).

Liquorland means Liquorland Australia Pty Ltd (ABN 82 007 512 414 - Liquorland), and its affiliated website www.liquorland.com.au.

Nominated Card means the debit or credit card or PayPal account you have nominated in connection with your Coles Plus Saver subscription online, or by subsequent notification to us and which, under these Terms and Conditions, we are authorised to charge the Subscription Payment.

Subscription Payment means the subscription payment amount for your Coles Plus Saver subscription that is applicable to your plan and disclosed to you at the time of purchase.

Subscription Period means one month from the date on which you purchased your Coles Plus Saver subscription and each successive one-month period in which the Coles Plus Saver subscription is renewed for monthly subscriptions.

Terms and Conditions means these Coles Plus Saver subscription Terms and Conditions.

Vintage Cellars means Liquorland Australia Pty Ltd (ABN 82 007 512 414 – Vintage Cellars), and its affiliated website www.vintagecellars.com.au

We, Us, Our and Coles means the entity or entities within the Coles Group that enters into these Terms and Conditions with you, including without limitation Coles Supermarkets Australia Pty Ltd (ABN 45 004 189 708) and Liquorland (Australia) Pty Ltd (ABN 82 007 512 414).
