#Ultimate Little Shopper - Competition terms

General

  1. The competition is a game of skill.
  2. The material used to market and promote the competition forms part of the competition terms. If there is an inconsistency between the material used to market and promote the competition and the competition terms, the competition terms prevail.

Eligibility to enter

  1. During the competition period, anyone may enter the competition, provided that they are:
    1. over 18 years of age;
    2. a resident of Australia; and
    3. not an employee or immediate family member of the promoter or an agent of the promoter who is connected with the competition.

Entering

  1. By entering the competition, entrants accept the competition terms.
  2. To enter, entrants must:
    1. Take an image or video that shows how they are Australia’s Ultimate Little Shopper. The entry can include minis from both Little Shop 1 and Little Shop 2. There are no restrictions to video length but please note that a stable WIFI connection may be required to upload larger videos to Facebook or Instagram.
    2. Submit their media to the hashtag #UltimateLittleShopper on Facebook or Instagram and tag Coles Supermarkets (@Coles on Facebook; @colessupermarkets on Instagram)
  3. Entrants may enter once per week, between the following dates:
    1. 2 August – 7 August
    2. 9 August – 14 August
    3. 16 August – 21 August
    4. 23 August – 28 August
    5. 30 August – 4 September
  4. Entrants who enter over multiple weeks can enter with the same or different entry submitted in previous weeks.
  5. Each of the weekly winners’ image or video will be automatically entered into a final round where the promoter will choose the most creative entry to be crowned Australia’s Ultimate Little Shopper.
  6. The promoter may deem as invalid any entry which:
    1. is illegible, incomprehensible, offensive or incomplete; or
    2. includes objectionable, profane, insulting, inflammatory or defamatory material.
  7. The promoter may disqualify any entrant who:
    1. enters the competition without being eligible;
    2. tampers with the entry process;
    3. submits an entry that is not in accordance with the competition terms; or
    4. in entering the competition, engages in conduct which is fraudulent, misleading, deceptive or damaging to the goodwill or reputation of the competition or the promoter.
  8. Failure by the promoter to exercise its rights under paragraph 9 or paragraph 10 does not constitute a waiver of the promoter’s rights under paragraph 9 or paragraph 10.
  9. If the entrant’s contact details change, the entrant must notify the promoter.

Drawing winners

  1. Each week, the promoter will shortlist two winners from the pool of valid entrants at the draw time on the draw date at the draw address. The two shortlisted winners will be loaded into an Instagram Story poll for Australia to vote and decide on that week’s winner.
  2. The entry with the most votes will be deemed the winner, subject to the promoter’s rights under paragraph 9 or paragraph 10.
  3. Each of the weekly winners will automatically go into another draw where the promoter will choose the most creative entry to be crowned Australia’s Ultimate Little Shopper.
  4. The entry deemed to be the most creative by the promoter is the winner, subject to the promoter’s rights under paragraph 9 or paragraph 10.
  5. The promoter will notify the winner within 2 days after the draw date. The promoter will post the winner’s name and city or town on the website within 2 days after the draw date.

Awarding prizes

  1. The promoter may request that the winner provide proof of identity, proof of age and proof of residency to the promoter’s reasonable satisfaction before awarding the prize. If the winner does not provide proof of identity, proof of age or proof or residency to the promoter’s reasonable satisfaction within 3 months after being selected as a winner, the promoter may redraw the prize in accordance with paragraph 22.
  2. The winner must accept the prize within 3 months after being drawn as the winner. If the winner does not accept the prize within 3 months after being drawn as the winner, the promoter may redraw the prize in accordance with paragraph 22.
  3. In consideration of the promoter awarding the prize to the winner, the winner:
    1. consents to the promoter using his or her name, likeness, image, voice and entry in any marketing and promotion of the competition, the promoter or the promoter’s business;
    2. agrees to use the prize in accordance with the supplier’s specified requirements; and
    3. agrees that the prize is not transferable or exchangeable and cannot be taken as cash.
  4. If the prize is unavailable, the promoter may substitute the prize with a substitute prize, provided that the substitute prize is of the same or similar value or specification as the prize.

Further draw

  1. If the winner does not provide proof of identity, proof of age or proof or residency to the promoter’s reasonable satisfaction within 3 month after being selected as a winner or if the winner does not accept the prize within 3 month after being drawn as the winner, the promoter may conduct a further draw from the pool of remaining valid entrants at the draw time on the further draw date at the draw address.
  2. The first drawn valid entry the promoter draws is the winner, subject to the promoter’s rights under paragraph 9 or paragraph 10.
  3. The promoter will notify the winner within 2 days after the further draw date. The promoter will post the winner’s name and city or town on the website within 2 days after the further draw date.

Force majeure

  1. If there is a force majeure event which prevents or materially and adversely affects the promoter’s ability to market, promote and run the competition in accordance with the competition terms, the promoter may cancel, terminate, modify, suspend or postpone the competition.

Liability

  1. The promoter is not liable for any loss, expense, damage or liability suffered or incurred by entrants and winners in connection with the competition, including:
    1. any late, lost, altered, damaged or misdirected entries or prize acceptance, including delays due to technical disruptions or network congestion;
    2. any incorrect or inaccurate information caused by equipment or programming associated with or utilised in the competition;
    3. any technical error, including any omission, interruption, deletion, defect, delay in operation or transmission or communications line, telephone, mobile or satellite network failure; and
    4. any theft, destruction, unauthorised access to or alteration of entries; and
    5. any use of the prize or any tax liability incurred by the winner as a result of accepting the prize.

Personal information

  1. The promoter collects personal information about entrants in order to run the competition and comply with the permits. The promoter uses and manages entrants personal information in accordance with its privacy policy. By entering the competition, each entrant consents to the promoter using their personal information for future marketing and promotional purposes

Eligibility to enter

  1. During the competition period, anyone may enter the competition, provided that they are:
  1. over 18 years of age;
  2. a resident of Australia;
  3. a current flybuys member or a new flybuys member who joins during the Promotional Period (to be a valid flybuys member, the flybuys member account must include the member’s full name, a valid email address, and postal address current at time of draw and prize distribution); and
  4. not an employee or immediate family member of the promoter or an agent of the promoter who is connected with the competition.

Entering

  1. By entering the competition, entrants accept the competition terms.
  2. To enter, entrants must:

  3. The promoter will notify the winners within 4 days after the draw date.  The promoter will post the winners’ names and city or town on the website within 4 days after the draw date.

Awarding prizes

  1. The promoter will contact the winners to request full name, address, phone number and flybuys member number. If the winner does not provide full name, address, phone number or flybuys member number to the promoter’s reasonable satisfaction within 3 months after being selected as a winner, the promoter may redraw the prize in accordance with paragraph 21.
  2. The promoter may request that the winner provide proof of identity, proof of age and proof of residency to the promoter’s reasonable satisfaction before awarding the prize.  If the winner does not provide proof of identity, proof of age or proof of residency to the promoter’s reasonable satisfaction within 3 months after being selected as a winner, the promoter may redraw the prize in accordance with paragraph 21.
  3. The winner must accept the prize within 3 months after being drawn as the winner.  If the winner does not accept the prize within 3 months after being drawn as the winner, the promoter may redraw the prize in accordance with paragraph 21.
  4. In consideration of the promoter awarding the prize to the winner, the winner:
  1. consents to the promoter using his or her name, likeness, image, voice and entry in any marketing and promotion of the competition, the promoter or the promoter’s business;
  2. agrees to use the prize in accordance with the supplier’s specified requirements; and
  3. agrees that the prize is not transferable or exchangeable and cannot be taken as cash.
  1. It may take up to 7 days for flybuys points to appear in the winners’ accounts.
  2. If the prize is unavailable, the promoter may substitute the prize with a substitute prize, provided that the substitute prize is of the same or similar value or specification as the prize.
